Frequently asked questions from heirs living outside the U.S.
Do I have to travel to the United States to handle a Florida probate case?
In most cases, no. Florida probate must go through the Florida court system and requires a Florida-licensed probate attorney, but we represent heirs who live abroad and manage the proceedings remotely on their behalf, including communication with the court and the other heirs.
What types of probate proceedings exist in Florida?
Florida has three main types: Summary Administration, a simplified proceeding used for small estates or when the decedent died more than two years ago; Formal Administration, the standard proceeding for larger estates or estates that include real estate; and Ancillary Administration, which is required when a person who lived outside Florida owned assets located in Florida.
Is the first consultation free?
Yes. We offer a free initial case review. If you inherited property or assets in the United States and are unsure how to proceed, contact us and we will help you understand your options.
What happens if the deceased left no will?
If someone dies without a valid will, Florida’s intestate succession laws determine who inherits the estate, typically prioritizing a surviving spouse and children, followed by other close relatives.
