Frequently asked questions from heirs living outside the U.S.
Do I have to travel to the United States to handle a Florida probate case?
In most cases, no. Florida probate must go through the Florida court system and generally requires a Florida-licensed probate attorney, but we represent heirs who live abroad and can manage most steps remotely, including communication with the court and other heirs.
What types of probate proceedings exist in Florida?
Florida commonly uses Formal Administration, Summary Administration and Ancillary Administration. The correct procedure depends on factors such as the estate’s value, the date of death, the decedent’s residence and the type and location of the assets.
How do I request an initial case assessment?
Contact our office with the decedent’s name, date and place of death, whether a will exists, and a brief list of known Florida or U.S. assets. We will review the available information and explain the next practical steps and representation options.
What happens if the deceased left no will?
If someone dies without a valid will, Florida’s intestate succession laws determine who inherits the estate, typically prioritizing a surviving spouse and descendants, followed by other relatives according to the statute.
